Please read these Terms of Service (together with our Privacy Policy located at https://learn.roadsacademy.com/privacy, and, where applicable, our Data Processing Addendum, the “Terms of Service”) carefully before using https://learn.roadsacademy.com (the “Site”) and the services, features, content, or applications offered by Roads Academy (“Roads Academy,” “we,” “us,” or “our”) (together with the Site, the “Services”). These Terms of Service set forth the legally binding terms and conditions for your use of the Services.

By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Site, you agree to these Terms of Service (including, for clarity, the Privacy Policy and, where applicable, the Data Processing Addendum) and all other rules, policies, and procedures that may be published from time to time on the Site. Arbitration Notice and Class Action Waiver: Except for certain disputes described in the Arbitration Section below, you agree that disputes between you and Roads Academy will be resolved by binding, individual arbitration, and you waive your right to participate in a class action lawsuit or class-wide arbitration.

You represent and warrant that you are at least 16 years of age. If you are under 16, you may not use the Services. The Services are provided solely for your personal or organizational use and not for resale or transfer. If you register on behalf of a company, entity, or third party, you represent that you have the authority to bind them to these Terms.

To use certain features, you must create an account (“Account”). You agree to provide accurate and current information and keep it updated. You are responsible for maintaining the security of your Account and password. Any unauthorized use must be reported immediately to us.

11) Arbitration Clause and Class Action Waiver
All disputes between you and Roads Academy will be resolved through binding, individual arbitration, unless otherwise required by law. You waive the right to bring or participate in class actions. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by providing written notice to legal@roadsacademy.com.
12) Limitation of Liability
To the maximum extent permitted by law, Roads Academy and its affiliates shall not be liable for indirect, incidental, consequential, or punitive damages, or for any amount exceeding the fees you paid to us in the three months prior to the claim, or $500, whichever is greater.
13) Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New York, United States. Any disputes shall be resolved in the courts of New York County, unless arbitration applies.

We may update or modify these Terms from time to time. Changes will be effective upon posting to the Site or notifying you by email. Continued use of the Services after such notice constitutes acceptance.
